Defender Commercial: VAT & Tax

The commercial Defender’s tax treatment is a major reason businesses choose one. Here is a clear overview of VAT, benefit in kind and vehicle tax, plus the rear-seat conversion point that deserves professional advice.

VAT

Because the Hard Top is classified N1 rather than as a car, a VAT-registered business using it for business purposes can generally recover the VAT on purchase — currently 20%. On a £65,000 vehicle that is a substantial number, and it is why commercial Defenders are advertised “+ VAT”.

That is also why you should read prices carefully. A car listed at £65,000 + VAT costs £78,000 to a non-recovering buyer.

The rear-seat question

A factory Hard Top can have two or three seats across the front, including Land Rover’s fold-down centre jump seat. That front-row arrangement is different from adding seats in the rear load area.

Adding rear seating can affect whether the vehicle continues to be treated as a commercial vehicle for tax. “VAT qualifying” describes how VAT is handled on the sale; it does not guarantee that every buyer can reclaim it. Benefit in kind

Commercial vehicles are generally taxed using the flat-rate van benefit charge rather than a percentage of list price and CO2. The charge changes over time, so ask your accountant to confirm the current figure and how it applies to your use.

Vehicle excise duty

Light commercials pay a flat VED rate — £360 — rather than the CO2-banded and expensive-car-supplement rates a Defender would otherwise attract. Over a period of ownership this compounds.

Capital allowances

Commercial vehicles are generally treated as plant and machinery rather than as cars, which affects how quickly the cost can be written down. This is the area where advice matters most and where the rules shift — ask your accountant rather than assuming.

When it is not worth it

If you are not VAT-registered, or the vehicle will be mostly private, most of the above evaporates and you are buying a Defender with no rear seats and no rear windows. That is a worse car for a private buyer than the standard version.
